New Jersey Woman Arrested for Reciting Constitution at Tax Meeting

Police in Clayton, New Jersey, confiscated two guns from a woman after she complained about county government moving to raise her property taxes and inspect her property without a search warrant.

Eileen Hart of Franklin Township was arrested and charged with making terroristic threats, disorderly conduct and harassing officials from the Gloucester County Office of Assessment and Appraisal Systems, Inc.

A county tax assessor told police Hart attended a meeting held with Franklin Township residents to discuss a property revaluation program the county instituted to “bring all home values up to the current market value,” according to the South Jersey Times.

Assessment and Appraisal Systems told the Gloucester County Times last August the pilot revaluation program is not about raising taxes. “A revaluation is not necessary to raise taxes,” Ernest DelGuercio, CEO of the assessment company, told the newspaper. “It ensures everyone is paying their fair share – no more and no less.”

Residents have complained the assessment program violates the Fourth Amendment. In order to make revaluation assessments and determine the tax value of a property, company inspectors must enter homes and inspect them. If not allowed to do so, the company often assesses higher values on homes, leading to increased taxes.

Eileen Hart said she did not allow the Assessment and Appraisal Systems to inspect her home because her husband was not present at the time. She also cited religious reasons. Because it was denied access, the company revalued her property at a higher rate. Hart attended the meeting last weekend to complain about the revaluation and the arbitrary move by the county to assess the value of her property.

After she began reciting the Constitution to support her argument, an Appraisal Systems employee escorted her from the public building.

“I didn’t scream, I didn’t yell,” she told the Examiner. “I have the right to air my grievances against the government in a public setting. I’ve never threatened anyone a day in my life.”

“She also wouldn’t let me speak and told me to sit down and shut up and listen as well,” she explained. “That’s when the young man came toward me. I knew he was going to put his hands on me. I saw him out of the corner of my eye. I said to him ‘Don’t you dare touch me.’ Then they threw us out of the auditorium. The young man from Appraisal Systems, Inc. was the one going postal, and I believe if he had a gun, he would have shot me (and my family) on the spot. I was calm the entire time.”

A spokeswoman for Gloucester County said the assessor “has never experienced this type of extreme behavior from a taxpayer” and the police were notified, apparently because reading the Constitution is considered extremist and a threat.

Although Hart exercised her Fourth Amendment right by not allowing an inspection by government without a court-issued warrant, it did manage to violate her Second Amendment right by confiscating her firearms.

After police arrested her, they demanded she hand over her two guns, a .357-caliber Smith & Wesson revolver and a .40-caliber Glock for “safekeeping.” If she had refused, a judge would have set bail too high for her family to pay.

“I have permits for each of them. I applied legally, I got them legally,” she said. “Now I can’t defend myself. I never said the word ‘gun’ at the meeting. None of those people would have even known I was a gun owner.”

  1. There appears to be a bit more to that story from what I am reading. The woman could have simply said to return when her husband returned home. Where I live, the Town does show up every now and then but, they are looking for illegal apartments or non-registered apartments or apartments where fire codes indicate egress windows and more than one means of egress out of the apartment leading to the outside of the structure. You can also simply refuse entry and the Town does have the right to jack up your taxes to the maximum and you must then through legal counsel petition the Town and appear at Town Hall meetings to have your taxes brought down. I don not know how it is where the alleged event took place, but it sounds like something else is in the background. The Town want to inspect smoke detectors and CO1 meters/alarms. If the house has monitored alarm including fire monitoring they want to simply see and not touch the unit (my unit is marked with the company name, “Fire Detector – Do Not Touch”). Never have I been asked about guns or given the slightest bit of problems, the inspectors were always good. Sounds like the woman drew attention to herself for whatever reason and now problems exist as she should have followed Zen, the path of least resistance, by permitting inspection and that would have been that. To me, the woman’s new tax bill, is a self-inflicted wound. All they wanted to do, from what I read, is look at the property, and not take her guns. I pay taxes, you pay taxes. It is what it is. We don’t care for it but in general, our local Towns are run by our neighbors, to help the residents. We have to accept that.

  3. Sorry Brittius, I disagree, I don’t have to accept anything.

    They do not have a right to enter your home for any reason. If the police need a search warrant why don’t all govt agencies?

    I have written and bitched incessantly about property taxes, they are unconstitutional and take away your RIGHT to life, liberty and PROPERTY.

    Being forced to hand over your guns for “safe keeping” without a trial and conviction of a felony is, in itself, a felony.

    Conspiracy Against Rights

    This statute makes it unlawful for two or more persons to conspire to injure, oppress, threaten, or intimidate any person of any state, territory or district in the free exercise or enjoyment of any right or privilege secured to him/her by the Constitution or the laws of the United States, (or because of his/her having exercised the same).

    It further makes it unlawful for two or more persons to go in disguise on the highway or on the premises of another with the intent to prevent or hinder his/her free exercise or enjoyment of any rights so secured.

    Punishment varies from a fine or imprisonment of up to ten years, or both; and if death results, or if such acts include kidnapping or an attempt to kidnap, aggravated sexual abuse or an attempt to commit aggravated sexual abuse, or an attempt to kill, shall be fined under this title or imprisoned for any term of years, or for life, or may be sentenced to death.

    Deprivation of Rights Under Color of Law

    This statute makes it a crime for any person acting under color of law, statute, ordinance, regulation, or custom to willfully deprive or cause to be deprived from any person those rights, privileges, or immunities secured or protected by the Constitution and laws of the U.S.

    This law further prohibits a person acting under color of law, statute, ordinance, regulation or custom to willfully subject or cause to be subjected any person to different punishments, pains, or penalties, than those prescribed for punishment of citizens on account of such person being an alien or by reason of his/her color or race.

    Acts under “color of any law” include acts not only done by federal, state, or local officials within the bounds or limits of their lawful authority, but also acts done without and beyond the bounds of their lawful authority; provided that, in order for unlawful acts of any official to be done under “color of any law,” the unlawful acts must be done while such official is purporting or pretending to act in the performance of his/her official duties. This definition includes, in addition to law enforcement officials, individuals such as Mayors, Council persons, Judges, Nursing Home Proprietors, Security Guards, etc., persons who are bound by laws, statutes ordinances, or customs.

    • As far as disagreeing with me, I understand.
      Many years ago, I bought an old house with tons of Character, and a wood burning fireplace that was spectacular. Loved that old house. I started fixing it up. Put in a rose garden, myself. Planted privacy hedges all around the half acre. Somebody illegally dumped Christmas trees and wreathes on the back of the property. Had to pay a $200.00 fine. I was mad and got the idea of, forests regenerate themselves after fires so I planted the trees and stripped down the wreaths and planted the boughs. Four years later after caring for all of my beautifully growing greenery and looked at the now beautiful house with brickwork and nice trim all clean. In the mail my tax bill soared. I was hotter than Hell, itself. I saw someone walking on my property one morning and confronted the man, I was armed with a revolver, which was holstered. Three patrol cars later… It was squared away and I told the taxman to stay off. Taxes kept going up as I scrimped pennies, never went anywhere, and spent my time on a ladder or roof, or tending the coiffed garden. The Town showed up with allegations that my children were borders. My wife nearly slapped them with birth certificates and our marriage certificate. Finally had enough and sold the magnificent house for a loss. Today, it’s a run down building. The greenery gone.
      The next house I simply let them look around and the taxes only went up as much as everyone else around me. There is no “winning”. I never again did the improvements as done on the other house. It is better than being jacked up to the maximum tax rate which the Towns can do lawfully, so on that score, better to give the Devil his due, and not draw any attention to yourself. I learned that the hard way. Warrants for inspection for Certificates of Occupancy, do NOT need a warrant for entry because you may refuse them but pay the maximum. Letting them in for a few minutes is painless unless a person keeps a home in less than clean condition. On that score, my wife hates when I clean because I keep the place, Barracks Clean, and continue to do so. I always received compliments from the old ladies of the Greatest Generation for my efforts. My wife and kids simply say when they see the first half of the movie, Full Metal Jacket, “Look, there’s Dad, and he’s wearing his Sergeant stripes, too!” The woman’s entire ordeal could have been avoided by saying to return when her husband was home or calling 9-1-1 and having a patrol car show up if she questioned her own safety. What was it we used to say? You Old Soldiers might remember it: “A hard head, makes a sore ass”.
